
What is a civil dispute?
A civil dispute is disagreement between private individuals/organisations or between a private individual and an organisation.
Civil dispute resolution options
The two options for resolving any civil dispute are:
- Alternative Dispute Resolution (ADR)
- Litigation in Court/Tribunal.
ADR refers to ways of settling dispute without going to court/tribunal. The most common ADR mechanisms are Mediation, Arbitration, Conciliation, Adjudication, Expert Determination, Settlement Discussion and Joint Settlement Meeting. We recommend using any of the ADR mechanisms before taking any dispute to court for resolution. Even when the matter had been taken to court, we still recommend out of court settlement using any of the ADR mechanisms. Our recommendation is based on our belief that ADR saves time and money for the client. Civil litigation in court/tribunal should be the last resort where ADR fails.
